SUBJECT:            SAFETY CONDITIONS AND PROGRAMS

Steps will be taken to protect the safety of all students, employees, visitors and others present on BOCES property, vehicles or at BOCES-sponsored events.

The practice of safety will also be considered an integral part of the instructional program through fire prevention and emergency procedures and drills. The administration of each school building shall instruct and train students, through fire drills, in procedures for leaving the building in the shortest possible time and without confusion or panic. Fire drills are to be held in accordance with Commissioner's Regulations.

Each supervisor will be responsible for working with the BOCES Safety Specialist to establish a safety program for his/her facility. Administrators in charge of after-school programs, attended by any individual unfamiliar with the school building, must announce at the beginning of such programs the procedures to be followed in the event of an emergency.

General areas of emphasis in the safety program will include, but not be limited to, in-service training, plant inspection, fire prevention, accident record keeping, and emergency procedures and drills.

Eye safety devices and any other appropriate safety equipment are to be used for the protection of employees, students and visitors, and worn in all appropriate classes and labs when activities present a potential eye hazard.

SUBJECT:            CHILDREN WITH DISABILITIES

The BOCES recognizes the existence of individual differences in the intellectual, social, emotional and physical development of children attending school in the component districts. In recognizing these differences the Board supports a system of services offered to component districts for students with disabilities.

Program Accessibility

The BOCES affirms its compliance with those sections of the Rehabilitation Act of 1973 dealing with program accessibility.

Section 504 of the Rehabilitation Act prohibits discrimination against qualified students with disabilities in federally assisted programs or activities solely on the basis of disability. The BOCES shall make its program and facilities accessible to all its students with disabilities.

The BOCES official responsible for coordination of activities relating to compliance with Section 504 shall provide information, including complaint procedures, to any person who feels his or her rights under Section 504 have been violated by the District or its officials.

All students with disabilities, including those requiring the use of psychotropic drugs, shall be provided with full access and opportunity to participate in BOCES programs and extracurricular activities which are available to all other students enrolled in the BOCES.

SUBJECT:        DISCIPLINE OF STUDENTS WITH DISABILITIES

The Board recognizes that it may be necessary to suspend, remove or otherwise discipline students with disabilities to address disruptive or problem behavior. The Board also recognizes that students with disabilities have certain procedural protections whenever school authorities intend to impose discipline upon them. The Board is committed to ensuring that the procedures followed for suspending, removing or otherwise disciplining students with disabilities are consistent with the procedural safeguards required by applicable laws and regulations.

This code of conduct affords students with disabilities subject to disciplinary action no greater or lesser rights than those expressly afforded by applicable federal and state law and regulations.

SUBJECT:            ADULT EDUCATION

The BOCES recognizes the value of education to people of all ages. As such, the Board encourages the District Superintendent to establish fiscally sound procedures to foster the enrollment of "adult" students in any appropriate existing program and to establish programs, where feasible, to serve this population when such service will not detract from our responsibilities to the school age residents of component school districts.

The pay rate for employees in BOCES operated adult programs will be established annually by the Board.

SUBJECT:            TUITION AND REFUND POLICY FOR ADULT STUDENTS

 TUITION PAYMENT REGULATION

A tuition payment plan will be established for each adult student enrolled in a Career and Technical Education program prior to their beginning the program. This plan may include a combination of monthly payments, Federal Financial Aid, and/or outside agency funding. Any student being sponsored, in part or in whole, by outside sources, including scholarships will provide the WSWHE BOCES with verification of these sources prior to including them as part of their payment plan. The cash component of the plan will be due to the WSWHE BOCES on the dates specified in the individual payment plan.

INSTITUTIONAL REGULATIONS

Students who withdraw officially or unofficially from any of the BOCES programs, or are officially dropped from the program, are responsible for payment of tuition as outlined below. Chargeable tuition will be based on the date the student officially withdraws or is officially dropped. If a student is sponsored by an outside agency, that agency will be billed accordingly as stated in this BOCES regulation, not to exceed the terms of their fiduciary agreement.

REFUND REGULATIONS

The WSWHE BOCES will provide a fair and equitable refund by utilizing our institutional regulations in conjunction with the required Federal “Return to Title IV” refund policy. Any cash excess remaining after determining the “Return to Title IV” calculations and institutional calculations will be issued directly to the student or, with the student direction, returned directly to the lender to reduce the student’s loan debt. Kits, books and supplies purchased from the WSWHE BOCES are considered non-reusable and fees paid for such are non-refundable. Unpaid balances may be turned into a collection agency if not satisfied in a timely basis and must be satisfied before a student re-enters any BOCES program

SUBJECT:            NON-DISCRIMINATION

Equal Opportunity

The BOCES contends that discrimination on the basis of age, color, religion, creed, disability, marital status, veteran status, national origin, race, gender, genetic predisposition or carrier status, or sexual orientation in any BOCES activity is not permitted. The Board further contends that administration shall be responsible for maintaining compliance with Standards Governing Civil Rights in Vocational Education Program.

Public Notification

The BOCES shall issue an appropriate public announcement which advises students, parents, employees and the general public that Career and Technical Education opportunities will be offered without regard to sex, race, color, national origin, religion, marital status, or disability. Included in such announcement will be the name, address, and telephone number of the person designated to coordinate Title IX/Section 504 activities.

Public notification shall be included in each announcement, bulletin, catalog or application made available by the BOCES.

Grievance Procedure

Grievance procedures for resolving complaints regarding discrimination based on sex and/or disability shall be disseminated to adequately inform students, parents and employees of the existence of these procedures.

SUBJECT:            LIVE WORK PROJECTS

On occasion, administration and faculty may involve students in services to agencies and individuals in order to provide needed learning experiences for the students as part of their regular curriculum. 

Because BOCES is using public funds and public facilities, no service will be designed to compete with private industry. To insure maximum understanding of this intent, live work procedures will be reviewed periodically.

The client for a live work project shall pay for and may be requested to order materials and/or supplies, plus a shop charge to help cover the costs of utilities and replacement of tools for all live work projects, not only those of the shop collecting the charge.

Potential clients should understand that the work will be performed for instructional purposes by students, not tradesmen or technicians, and that BOCES cannot be responsible for quality of work or time of completion.  Therefore, a proper sign-off form will be used to hold BOCES harmless.

The administration will, at least annually, inform BOCES staff, students, and the public concerning this policy, via internal handbooks and other appropriate means.  Such information will include the kinds of services offered, procedures for requesting the service, including sign-off forms where necessary, and eligibility, including order of priority. Administration will update operating procedures, keeping other staff informed and working with them to insure that the procedures effectively implement this and related Board policies.

In order to ensure consistency in development of career and technical education curriculum a standardized format shall be used.

SUBJECT:            TEXTBOOKS

The Board of Education is responsible for the adoption of all textbooks to be used in BOCES classrooms. The Superintendent or designee shall establish procedures for the selection and recommendation of textbooks and a method for selecting staff members who shall serve in the selection and recommendation process. Procedures shall also be designed to review complaints about curricula or instructional materials.

The BOCES shall furnish elementary and secondary students taking courses in its programs, all textbooks required. Students shall be expected to take reasonable care of all textbooks. Destruction or damage to textbooks shall result in a student having to replace the textbook or pay a fine at current replacement cost, including acquisition costs.

SUBJECT:            INTERNET SAFETY POLICY

Introduction:

Internet connection exists to facilitate the official work of the WSWHE BOCES, hereafter referred to as BOCES. The Internet facilities and services will contribute broadly to the mission of the organization.

The Internet connection and services are provided for employees and students affiliated with the BOCES.

The use of the Internet facilities by any employee or other person authorized by BOCES must be consistent with this policy and supporting administrative regulation.

Principles:

BOCES Internet users must:

Respect the privacy of other users.

Respect the legal protection provided to programs and data by copyright and license.

Protect data from unauthorized use or disclosure as required by State, Federal and WSWHE BOCES regulations.

Respect the integrity of computing systems.

Safeguard their accounts and passwords.

Terms and Conditions of Internet Access and Use:

The District Superintendent is directed to promulgate an administrative regulation to guide Internet access and use.  Internet use agreements must be completed by each student user, and parent/guardian, and renewed each year. Alternate instruction will be provided for students who may not have parental/guardian permission.

Organization Rights:

Pursuant to the Electronic Communications Privacy Act of 1986 (18 USC 250 et seq), notice is hereby given that there are NO facilities provided by BOCES for sending or receiving private or confidential electronic communications. System administrators have access to all mail and user access requests, and may monitor messages as necessary to assure efficient performance and appropriate use. Messages relating to or in support of illegal activities must be reported to the appropriate authorities.

BOCES reserves the right to log network use and monitor file server space utilization by users, and assumes no responsibility for files deleted due to violation of file server space allotments.

BOCES reserves the right to remove a user account from the network.

BOCES will not be responsible for any damages. This includes the loss of data resulting from delays, non-deliveries, or service interruptions caused by negligence, errors or omissions. Use of any information obtained is at the user’s risk.

BOCES reserves the right to change its policies and rules at any time. BOCES makes no warranties (expressed or implied) with respect to Internet service, and it specifically assumes no responsibilities for:

The content of any advice or information received by a user outside BOCES or any costs or charges incurred as a result of seeking or accepting such advice;

Any costs, liabilities or damages caused by the way the user chooses to use his/her BOCES Internet access;

Any consequences of service interruptions or changes, even if these disruptions arise from circumstances under the control of BOCES.  The BOCES Internet services are provided on an as is, as available basis.

Enforcement and Violations:

Pursuant to the Children’s Internet Protection Act (CIPA or CHIP Act), BOCES will operate a technology protection measure to block or filter Internet access to information that is deemed inappropriate for minors.

BOCES recognizes that the provisions of CIPA apply to minors and adults, including all students and staff, and that the Internet content filtering measure may be temporarily relaxed for authorized adult use for bona fide research or other lawful purposes.

BOCES cannot guarantee that users will not be exposed to inappropriate material.

Questions about specific uses not enumerated in this policy or concomitant administrative regulation should be directed to an administrator.

BOCES will review alleged violations of the Internet Acceptable Use Policy on a case-by-case basis according to existing procedures.

SUBJECT:            MEDIA/VIDEO/FILM PREVIEW AND PURCHASE

The BOCES shall collect and maintain an educational multimedia library for the purpose of assisting and improving instruction for those component districts which subscribed to its service.

A Media and Technology Council (consisting of representatives of participating component districts) shall be maintained to advise the library staff of purchases appropriate to instructional needs.

Purchase of recommended multimedia materials by the BOCES library solely for the purpose of making instructional materials available to participating schools and in no way shall be constructed to mandate or dictate the use of a specific item by any individual or school district.

SUBJECT:            CONTROVERSIAL ISSUES

Controversial issues may be studied as part of the curriculum and teachers shall present these issues in their classrooms in an impartial and objective manner.

Teachers wishing to call upon outside speakers in the presentation of controversial issues are required to obtain the approval of the program supervisor who shall keep in mind the obligation for presenting opposing views as well, and who shall inform the District Superintendent prior to the presentation.

If deemed appropriate by the program supervisor, parents or students have the right to request exclusion from exposure to controversial subjects.

It is also recognized that parents and citizens of the community have a right to object to perceived unfair and prejudiced presentations made by a teacher. In considering such objections, the District Superintendent shall provide for a hearing so that both parties may fairly express their views. If requested, the District Superintendent's decision may be appealed to the BOCES.

Instructional Materials Selection and Controversial Topics and Material

Legal Responsibility

a)         The BOCES, as policymaking and governing body, is legally responsible for the selection and approval of all printed and non-printed materials.

b)         The BOCES delegates the authority for the selection of materials to the instructional staff.

c)         Final recommendation on purchase should remain with the teaching staff, subject to approval by the District Superintendent and, where appropriate, the Board.

Objectives of Selection

a)         The selection should reflect and help implement the basic functions of a quality school and BOCES program.  The materials chosen should:

            1.            Provide teachers and students with materials which will support and enrich the curriculum.

            2.            Enable and encourage students to further develop their full potential as creative and responsible individuals by meeting and stimulating the greatest possible diversity of interest and abilities.

b)         To fulfill these two basic functions, endeavors should be made to provide easy access to a cataloged and comprehensive selection of a variety of materials at appropriate levels of difficulty to:

            1.            Generate an understanding of American freedom and a desire to preserve those freedoms through the development of informed and responsible citizenship.

            2.            Develop intellectual and practical skills, literacy and aesthetic taste and discrimination in choice of materials.

            3.            Foster a breadth and depth of insight, which will stimulate growth of ethical standards and a sensitivity of social, intellectual, aesthetic, and spiritual values.

            4.            Encourage students to locate, use, and evaluate as much material as possible on opposing sides of controversial issues so that they may develop, under guidance, the practice of critical examination and thinking.

            5.            Fairly represent the many religions, ethic, and cultural groups and their contribution to our American heritage.

            6.            Encourage the professional growth of the faculty.

c)            Controversial Topics and Material

All instructional curriculums will undoubtedly include controversial topics or materials, at one time or another.  For purposes of this policy, a controversial topic is one to which an individual formally objects as being inappropriate for use in a public school classroom. Guidelines shall be followed as indicated in administrative regulations.

The BOCES is committed to providing the most appropriate education available to its students. The BOCES encourages creativity and innovation in the use of instructional techniques and methodologies when those are determined to benefit the students and their families. The District Superintendent is directed to develop administrative regulations for the use of selected techniques determined to be innovative or creative by the District Superintendent or his/her designee.

SUBJECT:            USE OF COPYRIGHTED MATERIALS

It is the intent of the BOCES to abide by the provisions of the United States Copyright Law (Title 17, United States Code, Sections 101, et seq.).

All employees are prohibited from copying materials not specifically allowed by the copyright law, fair use guidelines, licenses or contractual agreements, or the permission of the copyright proprietor.

Regulations and procedures shall be developed by the administration detailing what can and cannot be copied.

SUBJECT:            LOSS OF INSTRUCTIONAL RESOURCES - FINANCIAL RESPONSIBILITY

The BOCES division, which has misplaced or lost an instructional item received from the Media Center, shall be financially responsible for replacing the missing item on the following schedule:

            a)            1 year old 100% of replacement cost;

            b)            2 year old 90% of replacement cost;

            c)            3 year old 80% of replacement cost;

            d)            4 year old 70% of replacement cost;

            e)            5 year old 60% of replacement cost;

            f)            6 year old 50% of replacement cost; or older

SUBJECT:            FIELD TRIPS

It is recognized that field trips are instructional techniques that increase instructional effectiveness. Teachers, with their respective program supervisor, must determine whether the field trip is the most appropriate procedure to meet the instructional objective.

Field trip parental permission slips must be completed and sent home with each participating student. A signed permission slip from the parent/legal guardian must be received before the student may participate in the trip.

All field trips shall be carried out in accordance with regulations and procedures developed by the District Superintendent.

Any overnight trip or trips that exceed 100 miles (one way) requires advance approval of the District Superintendent or designee.

SUBJECT:            SENIOR TRIP

Any trip so designated as a "Senior Trip" will adhere to Board policies relative to Fund Raising.

It is expected that Board authorization for a "Senior Trip" beyond 100 miles would be obtained at the beginning of the year and prior to any fund raising that might be undertaken to pay for the trip.

Program supervisors should budget funds to help pay for the cost of the senior trip.
